GENERAL CONDITIONS AND BOOKING RATES
INTRODUCTION
The purpose of this document is to inform you about the general conditions applicable to the management of reservations through our Booking Engine system (hereinafter BE).
On the BE system you will find information on the availability of rooms, rates and services offered by the accommodation facilities managed by ECO-TOURISM S.R.L.S. (from now on ECO-TOURISM).
The management of reservations implies full and unconditional acceptance of the legal notice, the privacy policy and these general conditions in the latest updated version. Therefore, before making any booking and each time you access our BE system, we recommend that you read these conditions, as we reserve the right to modify, add or remove any part of these conditions at any time.
CLAUSES
The formalization of reservations through the BE system is subject to the following clauses:
1. STATEMENTS:
The user declares under his/her responsibility:
- To be of age and have full capacity to formalize the booking, declaring that you understand all the conditions present in the BE system.
- That the information provided at the time of booking is true, complete and concise.
- Which confirms the requested booking and in particular the dates indicated, the number of rooms, the number of people, the accommodation and the formula chosen.
2. ACCESS TO THE BE SYSTEM
Access to this BE system is your responsibility.
3. SUBSCRIPTION OF PRODUCTS AND SERVICES THROUGH THE BE SYSTEM:
3.1. The booking includes the services detailed according to the booking conditions stipulated on the BE system in which such booking is requested or formalised.
3.2. ECO-TOURISM will be responsible towards the user for compliance with the obligations deriving from current legislation and from the terms and conditions of sale of all products and services subscribed to. The user accepts that ECO-TOURISM does not assume any obligation or responsibility regarding the services that it does not provide directly (in particular, regarding the lack of truthfulness, completeness, updating and/or precision of the data or information on offers, products or services, prices, characteristics and any other relevant data and information regarding products and services not provided directly by ECO-TOURISM).
3.3. Before formalizing the booking, the user must accept these general conditions. The contract can be validly formalized in any of the languages available on the BE system.
4. THE PROCESS OF FORMALIZATION OF THE RESERVATION ON THE BE SYSTEM TAKES PLACE IN 4 PHASES:
a) Availability: Search for dates, number of people and rooms.
b) Choice of regime and type of room, rate.
c) Booking summary, collection of customer data and, if applicable, payment via Credit Card, Bank Transfer, PayPal or Remote POS.
d) Confirmation of booking.
Once the booking has been made, the emails and logs generated by the operation will be archived. The customer will receive the details of his booking via email or via messaging systems.
5. PRICE AND PAYMENT:
5.1. The conditions, price and payment of the intended stay are those expressly established in the tariff conditions included on the BE system in which the reservation is made.
5.2. The promotions and offers will be valid only during the period in which they remain accessible to the recipients of the service and in any case not after completing the booking: from that moment the selected rates/promotions remain unchangeable.
5.3. The prices indicated on the BE system are retail prices including VAT. The transaction will be carried out in EURO, regardless of the origin of the customer.
6. CANCELLATIONS/MODIFICATIONS OF RESERVATIONS AND NO-SHOWS:
6.1 Depending on the applicable conditions based on the tariff selected by the customer.
6.2. All charges applied can be made to the credit card provided during booking. By doing so, you expressly consent to the charging of such expenses to cover any penalties applicable in the event of cancellations or no-shows.
7. NOTIFICATIONS
All notifications, requirements, requests and other communications to be made by the parties in relation to these general conditions must be sent via email to [email protected].
8. INVALIDITY OF THE CLAUSES
If one or several clauses included in these general conditions should be declared totally or partially null or ineffective, this will only affect that provision or that part which has been so declared, while the general conditions will remain in force in all other respects and such provision, or the part of the same affected will be considered as not in force.
9. ACCEPTANCE
The request and formalization of the reservation necessarily imply the acceptance of each of these general conditions, considered as an integral part of the reservation and completed with the tariff conditions and the specific applicable legislation.
10. APPLICABLE LAW AND JURISDICTION
This contract is governed by Italian law and for any dispute that may arise regarding its validity, execution, fulfillment or termination, total or partial, the parties expressly submit to the jurisdiction and competence of the Courts of Lecce (Italy).
